TERMS AND CONDITIONS – GROUP CLASSES (MERRY MUSIC MAKERS)

1. Enrollment and Class Minimums
All group classes, including but not limited to Music Together® and other weekly offerings (collectively, the “Classes”), are subject to minimum enrollment requirements. Merry Music Makers (“MMM”) reserves the right, in its sole discretion, to cancel, reschedule, or modify any Class due to insufficient enrollment or other operational needs. A minimum of five (5) enrolled families is required for a Class to be held.

2. Schedule Changes
Participants may request a change to their originally selected Class day and time, subject to availability and MMM’s approval. MMM does not guarantee that alternative placements will be available.

3. Make-Up Classes
MMM may, at its discretion, offer make-up classes for missed sessions. Make-up classes:

  • Must be scheduled through MMM’s designated scheduling system or by contacting the office;
  • Are subject to availability;
  • May roll over into future sessions; however,
  • May only be redeemed while the participant is actively enrolled in a current MMM session; and
  • Shall have no cash value and are non-transferable.

Make-up classes may not be used for drop-in classes or as a substitute for full session enrollment.

4. Tuition and Materials
Tuition payments shall be made directly to MMM and not to individual instructors. Instructors are not authorized to accept or process payments. Class materials will be distributed on or after the first scheduled Class, provided that all tuition and fees have been paid in full.

5. Cancellation and Refund Policy
In the event of withdrawal prior to the first scheduled Class, MMM shall issue a refund of tuition paid, less a non-refundable administrative fee of twenty-five dollars ($25.00). No refunds, credits, or transfers shall be granted after the commencement of the first Class, regardless of attendance or participation.

6. Health and Safety Policy
Participants agree to refrain from attending Classes if they or their child(ren) exhibit symptoms of illness. MMM reserves the right to deny entry to any participant displaying signs of illness in order to protect the health and safety of others.

7. Photo and Video Release
MMM may request verbal consent from participants and/or their parent or legal guardian prior to the commencement of any Class or event to photograph, record, or otherwise capture the name, likeness, voice, and image of the participant and their child(ren) (collectively, the “Media”). By providing such verbal consent, the undersigned grants MMM, its affiliates, licensees, successors, and assigns, an irrevocable, perpetual, worldwide, royalty-free license to use, reproduce, publish, distribute, and display the Media in any and all media now known or hereafter developed, including but not limited to digital, print, broadcast, and online formats, for purposes including, without limitation, advertising, promotion, marketing, education, and public relations.

The undersigned:

  • Acknowledges that verbal consent constitutes a binding authorization for such use;
  • Waives any right to compensation arising from such use;
  • Waives any right to inspect or approve the final materials or their use; and
  • Acknowledges that all rights, title, and interest in such Media shall vest exclusively in MMM.

This consent shall remain in effect indefinitely unless revoked in writing, and such revocation shall apply prospectively only.

8. Assumption of Risk and Waiver of Liability
The undersigned acknowledges and agrees that participation in Classes involves inherent risks, including but not limited to the risk of personal injury, illness, or property damage. As a condition of enrollment, the undersigned voluntarily assumes all such risks on behalf of themselves and their child(ren).

To the fullest extent permitted by law, the undersigned hereby waives, releases, and discharges MMM, its owners, officers, employees, instructors, agents, and affiliates from any and all claims, liabilities, damages, or causes of action arising out of or related to participation in the Classes or presence on MMM premises or any satellite location, including but not limited to claims arising from negligence.

9. Parental Responsibility and Supervision
Parents, legal guardians, or caregivers are solely responsible for the supervision, safety, and conduct of their child(ren) at all times while on MMM premises or participating in MMM programs at any location.

10. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles.

11. Acknowledgment and Acceptance
By registering for MMM Classes, the undersigned acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions and that they have the legal authority to enter into this agreement on behalf of themselves and their child(ren).
